Club Soda Terms and Conditions


  1. If you create an account in our stores, online via the registration form on our website, in the Club Soda app, or you subscribe to our newsletter, you will automatically become a member of Club Soda. If you have already created an account in the past, you also automatically became a member of Club Soda. We informed you about this by email.   2. As a member of Club Soda, you receive personalized offers and promotions based on your purchasing behavior in our stores and online shop, unless you opted not to receive such offers or promotions in your account. When you purchase Scotch & Soda products from one of our partners, such as department stores or shop-in-shops, these purchases are not registered in your account. The minimum age to become a Club Soda member is 18 years old.
  3. Membership is strictly personal. Offers or promotions that have been received cannot be transferred to other persons.
  4. You can always make changes to your account by signing into your personal account. It is also possible to make changes (or have those changes made) in our stores with the help of our staff or by contacting Consumer Care using the contact form
  5. In principle, Club Soda membership is indefinite. Scotch & Soda retains the option of deactivating your membership at any time. It goes without saying that you also have the option of deactivating your membership at any time. You can do this by contacting Consumer Care using the contact form. In the contact form, you can select “My account” as the subject, followed by “Account deactivation”.
  6. Scotch & Soda reserves the right to unilaterally change these terms & conditions, as well as the Club Soda membership, at any time. In such cases, we will inform you of the changes by email. If you disagree with the changes, you can of course deactivate your membership in the manner described in Article 5 of these terms & conditions.
  7. If you no longer wish to receive our newsletter, you can unsubscribe at any time using the link in the footer of the newsletter.
  8. Benefits

  9. As a Club Soda member, you are entitled to certain benefits, such as extra offers, early acces to new collections and sale, or win promotions. We will inform you of such upcoming and/or ongoing benefits, unless you opted in your account not to receive such notifications. Upcoming and ongoing benefits and promotions can also be found on Club Soda.
  10. Personal data

  11. All the personal data that we collect through your Club Soda membership is exclusively used for (direct) marketing communication such as personalized offers and promotions from Club Soda. You may receive this (direct) marketing communication either by email or by push notifications through our Club Soda app. If this is no longer desired, this can be switched off in the Club Soda app under “Settings”. We use this (direct) marketing communication to inform you about offers, promotions, benefits, giveaways, (discount) sales, products and (forthcoming) Scotch & Soda events. If you would like to unsubscribe from our email marketing communication, you can click on the unsubscribe link in the footer of our emails or in your personal Club Soda account.
  12. Scotch & Soda processes the following personal data associated with Club Soda membership:

    • "First name and surname";
    • Gender;
    • Address details;
    • Email address;
    • Text message (US);
  13. Digital customer card

  14. After creating a Club Soda account, you will receive a digital customer card containing a visible [QR code/unique ID number] linked to your account. This digital customer card will automatically be added to your Club Soda account. If you like, you can then add this digital customer card to your iOS or Android Wallet (hereinafter “Mobile Wallet”).
  15. We communicate with you through your Mobile Wallet by sending you push notifications. Push notifications are sent based on your geolocation and/or CRM segmentation (such as your interests profile based on purchasing behavior). We will of course only send you push notifications if you indicated that you want to receive such notifications through your Mobile Wallet. You can adjust the preferences by switching them on or off yourself. This applies to push notifications based on our CRM segmentation and push notifications based on your geolocation. As soon as you have activated your digital customer card in your Mobile Wallet, your telephone can be identified when it’s near one of our stores. Based on that, you may receive a push notification regarding any applicable sales in that particular store.
  16. If you purchase a Scotch & Soda product from one of our stores, we may ask you to show the QR code on your digital customer card, your email address or your zip code and house number. Your purchases will then be registered in your Club Soda account. If you are logged into Club Soda while placing an order in our online shop, your purchases will also be registered in your Club Soda account. Insofar as not being mentioned here, Scotch & Soda processes your personal data in line with its Privacy policy.
  17. Applicable law

  18. These Terms and Conditions and the agreements concluded between you and Scotch & Soda are governed by Dutch law, with the exclusion of the Vienna Sales Convention. This choice of law does not affect any further protection that you enjoy on the basis of the mandatory provisions of the law that would apply without this provision.
